These user (or the “Terms”) are issuedby ALBERTS NV, incorporated under the laws of Belgium, with registered office at 2110 Wijnegem, Bijkhoevelaan 32c, Belgium, with enterprise and VAT number BE0635.874.689, RLE Antwerp (district Antwerp) – hereinafter referred to as “Alberts” and apply to the use of our website www.alberts.be and the use of our app (hereinafter also referred to as the “Service” or “Services”).
By accessing and using the website and/or our app, you explicitly agree to the following terms and conditions. These Terms should be read together with our Privacy Policy, which you can find here.
A. Intellectual Property Rights
You receive non-exclusive, personal, non-transferrable, temporary, royalty-free, non-sublicensable user rights. You may use our website and app for the intended Services.
The content of this site, the app and its content, including the trademarks, logos, drawings, data, product or company names, texts, images, etc. Are protected by intellectual property rights such as copyrights, database rights, domain rights, patents and belong to Alberts or third parties. ‘Alberts’ is a trademark owned by Alberts. You are not entitled to reproduce or share the information without the explicit approval of Alberts. By submitting materials to Alberts, you warrant and represent that you hold the copyright, trademark and/or other intellectual property rights to your own content (hereinafter referred to as “User Material”). You agree to grant Alberts a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use User Material to the extent necessary for Alberts to operate and maintain the Service. This license shall remain valid until the respective User Material is deleted from the Service by you or by Alberts in accordance with these Terms.

However, Alberts cannot be held liable for any malfunction or temporary unavailability of the website or app or for any form of direct or indirect damage arising from the use of our services.

C. Using our Services
To use our Services we have listed some simple house rules. The Service is only available for your private use and is not intended for commercial use. Do not misuse the Services, so that either Alberts or anyone else is harmed in any way. You may only use the Services as permitted by law and these Terms.
By using our Services, you agree that:
- All of the personal data provided by you is accurate and up-to-date. In this context we also refer to the provisions of our Privacy Policy.
- You are solely responsible for all activities on your account and all User Material that is uploaded and/or created under your ALBERTS account. You may not engage in any commercial activities, advertise and/or provide hints (such as links) through which commercial activities are presented on our Services. You may not contribute any propaganda, religious and/or political views, or contribute information which in any way contains or involves incitement to racial hatred, child pornography or pornography through the use of our Services. Furthermore, you may not defame, discriminate, harass or offend other people through the use of our Services.
- Alberts does not monitor the contents of the Service, but may at any time choose, at its sole discretion, to remove User Material from the Service and/or your user account and to terminate your account and membership.
- You may not transmit, and/or distribute files that could damage Alberts or others’ computers or property (such as viruses and trojan horses).
- You will at all times respect Alberts’ rights and reputation.
Your membership, including your email and password, with ALBERTS is personal and may not be transferred or used by anyone else other than yourself. You are responsible for storing your personal login details in a safe manner. Alberts is not in any way responsible for any loss or damage caused by unauthorized access to your account or use of your login details. If you learn of or suspect any unauthorized use of your account, inform us immediately. You can use the provided contact form on our website or you may contact us through team@alberts.be.
Violation of any of these Terms will lead to a direct termination of your user account. Also after termination the relevant terms of these Terms will continue to apply such as the provisions with regards to intellectual property rights, complaints and liability.
D. Feedback and complaints
If you have any criticism or feedback regarding Alberts or our Services, kindly Alberts contact at the soonest and help us to improve our Services. You may use the contact form or contact us via team@alberts.be.
Our liability is in any case limited to liability for direct damages and ten thousand euro (€ 10.000,00) per case. We do not limit our liability in case this would not be allowed following the applicable laws.
E. Modification
Any deviation is only valid after the explicit prior written approval of Alberts.
We may at all times modify these Terms. As such we recommend to consult these Terms periodically. If needed following the applicable laws, you will be notified explicitly.

F. Miscellaneous
You are not allowed to transfer (part of) this agreement to a third party without the explicit written approval of Alberts.
In the event that any one or more of the provisions contained in these Terms shall be held to be void, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby. In the event that any one or more of the provisions shall be held to be void, we will replace the void provision(s) by (an) equivalent provision(s) with the same general spirit.
Not executing one or more rights, does not automatically means we waive our rights.
G. Applicable Laws and Jurisdiction
Belgian laws apply to the use of this website and the Alberts app and these Terms. In case of a dispute the courts of our registered office will have exclusive jurisdiction.
